The lawsuit filed for the cancellation of the 3rd Ordinary General Assembly of the "Öz-Sağlık-İş" Union, which is affiliated to the Confederation of Workers Unions (Hak-İş), which was held 2 years ago, was resolved at the Court of Cassation.
In the statement made by the Supreme Court, it was stated that it was decided to appoint a trustee to the union, as well as to hold a new General Assembly.
Öz-Sağlık-İş Union Board of Directors made statements regarding the decision rendered at the Supreme Court stage, noting that the decision was not fair, equitable and proportionate.
"At the point reached in the legal process that started with the request to cancel our 3rd Ordinary General Assembly, which we held on 20/21 November 2021; It has been decided to renew the delegate elections and the 3rd Ordinary General Assembly held in provinces that do not have branches. At the end of the process, our union will continue on its way by holding a new General Assembly. The fact that this situation, which was caused by some deficiencies contrary to the statute and regulation, resulted in an excessive sanction, damaged the trust in the law and the conscience of the public," the statement said.
“WE ARE TAKING A BREAK FOR A SHORT TIME”
In the statement underlining that the headquarters administration and the organizations are not accused of corruption, theft or forgery, it is stated that the committee to be appointed will be assisted.
"Our union's activities in the health and social services sector, organizing efforts, collective bargaining agreements and lawsuits filed to defend the rights of our members will continue without interruption. As the Board of Directors, we are not saying goodbye, we are taking a break for a short time. In the General Assembly to be held by the trustee, we will be considered as natural candidates by law. With the support of our Öz Sağlık-İş organizations and our re-elected delegates, we will continue to serve health and social service workers from where we left off," the statement added.
LAST ACTION BEFORE THE DECISION TO GIVE THE WORKER'S RIGHT TO RETURN
It was noteworthy that the last action he took before the appointment of a trustee to the union was the action carried out in Turkey for the retroactive payment of receivables of health workers.
In the action that took place last week, it was emphasized that 46 days have passed since the Collective Bargaining Agreement signed between Öz Sağlık-İş Union and TÜHİS and that the retroactive receivables of the worker included in the agreement, valid as of January 2023, have not been paid.
