The reinstatement of civil servants, who were dismissed by statutory decrees after the state of emergency and then justified through the courts, is delayed.

Felicity (Saadet) Party Konya Deputy Abdulkadir Karaduman brought the issue to the agenda of the Assembly. Karaduman asked the Minister of Interior Süleyman Soylu about the situation of T.B. who was dismissed from his police duty but was later reinstated by the court.

WHY IS IT NOT REINSTATED EVEN BY THE COURT DECISION?

Reminding that in the parliamentary question submitted by Karaduman upon the request of Minister Soylu to answer, the court decided to return all personal rights to T.B. and said, "The said decision has been notified to your Ministry on November 10, 2021. It is emphasized in Article 2 of the Constitution that the Republic of Turkey is a state of law, and in the last paragraph of Article 138, ‘Legislative and executive organs and the administration must comply with court decisions; These organs and the administration cannot change the court decisions in any way and they are replaced by them.’ There is a clear, definite and imperative rule such as 'can not delay the delivery of the decisions.’ Even though there was a court decision to hand over his rights to T.B. and the mandatory period determined for the implementation of this decision has been exceeded, your Ministry has not taken any steps in this regard.”

HOW MANY OF THE DECISIONS HAVE YOU IMPLEMENTED?

Karaduman asked the following questions to the Minister of Interior Süleyman Soylu in the continuation of the parliamentary question:

“In the last five years, how many personnel have been dismissed from their duties within the body of your Ministry? How many of these personnel have returned to their duties?

While the final decision of the court about the dismissed T.B. is clear, why does your Ministry not implement this decision?

In this direction, how many of the final court decisions have you implemented?”
