Umut Yılgın, the child of the Yılgın family, who was born in Göztepe Training and Research Hospital in 2007, became one hundred percent disabled due to alleged negligence. Umut Yılgın's father, who had to live in difficult conditions for 14 years due to the negligence of the hospital staff, has been trying to hold those responsible accountable for years. When the Istanbul Governor's Office prevented the opening of a criminal case, his father Mehmet Yılgın also filed a lawsuit for material and moral compensation. The compensation case, which was rejected on the grounds of time-out, and the case, which started to be heard again with the decision of the Council of State, "There is a violation of human rights", is now blocked due to the expert report not given by the Forensic Medicine. Mehmet Yılgın, who sought the rights of his son, who became disabled due to negligence, told the Milli Gazete about the turmoil of the case.
“After being in the incubator for 45 days, they said my child was 100 percent disabled”
Mehmet Yılgın, who has been fighting for the law for 14 years to hold accountable those who caused his child to be disabled, "My son Umut Yılgın was born by cesarean section at the age of 32 weeks at Göztepe Training and Research Hospital in 2007. Despite the premature birth, my child was not put in the incubator and they made us wait for about 2 hours. I saw that my child was starting to bruise and told our doctor. However, my doctor sent me from the obstetrics ward to the children's ward. I walked the distance of 400-500 meters with my child on my lap. Later, when I was discharged after being in the incubator for 45 days, they said that my child was 100 percent disabled. My child has become like this because he was without oxygen for 2 hours," he said.
COUNCIL OF STATE SAYS 'THERE IS A VIOLATION OF HUMAN RIGHTS'
Mehmet Yılgın, by describing the turbulent legal process, "We filed a criminal case against the negligence of the hospital staff. However, a criminal case was not allowed by the Istanbul Governor's Office. I also filed a lawsuit for material and moral damages with my witnesses and documents. Our request for a lawsuit was not accepted due to the statute of limitations, and then, upon our application, the Council of State said that there is a "human rights violation". After the decision of the Council of State, it decided to re-hear the case. During the litigation process that lasted for years, an "expert report" was requested from the Forensic Medicine Department in 2018. Since Forensic Medicine gave ambiguous answers to 5 questions asked by the court, an expert report was requested again. However, Forensic Medicine did not recognize the court decision and did not prepare a new expert report. The court abruptly ended the case," he added.
“UNFORGETTABLE AND UNLAWFUL PROCESS”
Mehmet Yilgin, "We know that we are right, but as a result, we are faced with a 14-year legal scandal. We haven't been able to reach a conclusion for 14 years. Forensic Medicine does not recognize the court decision, the court concludes the case before the second expert report requested by Forensic Medicine is received. Now our case is in the court of appeal. We are faced with a completely unfair and unlawful process. Because of someone's negligence, my child was one hundred percent disabled and those responsible have not yet been held accountable. I will go to the end and ask those who caused us this pain to account," he stated that he will continue his righteous struggle.
