The supervision of companies carrying out savings financing activities was transferred to the Banking Regulation and Supervision Agency (BDDK) with a decision taken. Accordingly, after the amendment made in the Financial Leasing, Factoring, Financing and Savings Financing Companies Law, the BRSA decided to liquidate 21 savings finance companies on the grounds that they could not meet the adaptation conditions. However, approximately 45 thousand citizens, who have investments in 21 companies that provide services with the promise of interest-free housing and vehicle purchases, are at a loss as to what to do. Speaking to the Milli Gazete on the subject, Honorary President of Consumer Application Center Aydın Ağaoğlu explained what can be done after the liquidation decision of the BDDK.

“BDDK SHOULD TAKE A SERIOUS MEASURE AND MAKE AN ANNOUNCEMENT”

Aydın Ağaoğlu, Honorary President of the Consumer Application Center, said that 21 savings finance companies met with the BDDK before the liquidation.

"We visited the BDDK so that more people would not be victimized by savings finance companies, and 2 days later, a liquidation decision was made. The BDDK should have taken a measure to secure the rights of around 45 thousand citizens investing in these companies. It was necessary to transfer the consumers in the 21 liquidated companies to the 6 savings finance companies that continue their activities. But now there is uncertainty about what will happen with the money that 45 thousand of our citizens have invested in 21 companies so far. In other words, the BDDK should have taken a serious measure and made a statement after that," he said.

“45,000 families are victims right now”

Aydın Ağaoğlu stated that approximately 200 thousand people were indirectly affected by the liquidation decisions taken, "The families of 45 thousand people who have invested in these companies are also victimized at the moment. It is clear what our citizens have to do to get their rights back. By addressing the companies they invested in, they said, 'You organized an organization against the law and included us. Therefore, I want the price I paid to be refunded to me. If there is no positive response to this request, legal action must be taken," he added.

“WE WILL WAIT FOR THE RESULT OF THE LEGAL PROCESS TO FOLLOW WITH THE CRIME OF FRAUD”

Aydin Agaoglu, "If our citizens who want to get their investments back do not get a positive response from the liquidated companies, they should apply to the public prosecutor's office. In addition, consumers must apply to arbitration committees for up to 11 thousand 330 TL, and to mediators in courthouses for more than 11 thousand 330 TL. If a compromise is not reached here, a lawsuit can be filed in consumer courts without paying any fees. If the companies causing the victims have assets, then the investors can get their money through the judiciary. If the companies that cause the victims do not have assets, unfortunately, the result of the legal process that will proceed with the crime of fraud will be awaited," he said.
