Felicity (Saadet) Party Deputy Abdulkadir Karaduman brought the 1 percent threshold portion of the 400 TL collective bargaining bonus to be given to unions with more than 1 percent membership to the agenda of the Turkish Grand National Assembly.
Karaduman, who submitted a parliamentary question to the chairman of the parliament with the request of the Minister of Labor and Social Security Vedat Bilgin to answer, stated that the part of the dam is against the Constitution and the international conventions that Turkey has signed.
“1 PERCENT DAM IS UNCONSTITUTIONAL”
Felicity Party Konya Deputy Abdulkadir Karaduman stated that many unions could be closed due to the 1 percent threshold brought in order to pay the collective bargaining bonus, "Public employees are paid a wage called union bonus or Collective Negotiation bonus in order to encourage being unionized. While this fee was 135 lira in 2020, this figure was increased to 400 lira in the Collective Agreement negotiations covering the years 2022 and 2023. However, public employees were prevented from choosing their unions of their own free will, as this bonus was given to union members who completed 1 percent of their union organization. This issue is contrary to Article 51 of the Constitution, Law No. 4688 and international conventions signed by Turkey," he added.
“REGULATION WILL CAUSE MONOPOLIZATION”
Karaduman, who asked the Ministry's work regarding the threshold condition introduced with the 6th Term Collective Agreement, asked Minister Bilgin the following 4 questions;
1-Does your Ministry have knowledge and involvement in this problem, which will prevent polyphonic union activities and cause monopolization in union activities in Turkey?
2-Do you follow the ongoing legal process on the subject? Will you do something to fix this problem and make the arrangement reasonable?
3-What is the number of unions that will be closed if the legal process is negative? What is the number of individual members of these unions?
4-What are your suggestions for solutions for employees who are members of unions facing the danger of closure?
