A special education teacher in Bursa applied to the court with the request of paying the additional tuition fee that was not paid due to the student's failure to attend the classes. Evaluating the situation as to whether additional course fees can be paid in case there are no students in the classroom even though the teacher goes to school, the court made an exemplary decision and gave the teachers the light of hope regarding the additional course fee.
In the statement made by the Educators Union (Egitim-Bir-Sen) on the subject, it was stated that the teacher was a member of Eğitim-Bir-Sen Union, and said, “Cancellation of the process regarding the rejection of our special education teacher member's request for payment of additional tuition fees for the period when the student did not attend school. The court ruled that the requested additional course fees should be paid on the grounds that due to the actual impossibility without our member’s own fault, the additional course duty could not be fulfilled.”
CANNOT FIND A DEFECT OF THE TEACHER IN THE LESSONS THAT CANNOT BE FULFILLED
In the decision announced by Bursa 2nd Administrative Court, while it was stated that the task did not originate with the teacher, it was pointed out that the lesson could not be realized because the student who should have been in the classroom did not come to school. While it was stated that the teacher was present at the school during the lesson hours when the additional lesson application would be made, it was stated that it was decided to pay the additional lesson fees to be paid during the additional lesson period, since the teacher did not have a fault for not performing the lessons that could not be done.
