While the effects of the economic crisis in Turkey are increasing day by day, the number of citizens who cannot pay their debts and who are in execution is increasing day by day.
The number of files in the enforcement offices has passed the 24 million threshold.
Companies or individuals who want to collect their receivables initiate foreclosure proceedings even on the grave of the debtor.
It turned out that 49 separate foreclosure proceedings were initiated on the grave in Mardin of a citizen who did not pay his credit card debt.
An asset management company lawyer faced 48 liens on the grave he seized.
Economic conditions caused the number of files in enforcement offices to increase to 24 million.
Enforcement proceedings have been initiated up to the burial places of debtor citizens.
One of the most striking examples of this came across an asset management company lawyer.
Accordingly, when the credit card debt, which was 15 thousand 429 lira and 88 cents in 2016, was not paid until 2022, the bank transferred its receivables to the asset management company.
The debt, which was 15,429 lira and 88 kurus in 2016, increased to 47,855 TL due to interest and other expenses.
STARTED THE PROCEEDING LIEN
The attorney of the asset management company has started proceedings to put a lien on the vehicles and real estate registered in the debtor's name for collection.
Meanwhile, the burial place registered on the debtor was also identified.
A foreclosure process has also been initiated for the burial place in the Kovalı village of Derik district of Mardin.
But the asset management company's attorney saw 48 separate liens for burial sites before him.
“SOCIAL SECURITY INSTITUTION INSURANCE PUTS LIEN ON THE GRAVES FOR ITS CREDITS, THIS IS WRONG APPLICATION”
Lawyer Ceren Şarman evaluated whether the graves could be confiscated.
Şarman stated that the document obtained from the municipalities for a fee for the burial place is not actually a title deed, contrary to what is known.
"Cemeteries cannot be confiscated. There are also decisions of the Supreme Court in this direction. The foreclosure process made here is incorrect and the debtor must appeal. In fact, this is what caught my attention. The Social Security Institution also placed a lien on the cemetery for its receivables. In other words, the state institution places a lien on a property belonging to the state. A different situation arises here," Şarman said.
