The Law on Amending the Attorneyship Law and the Turkish Code of Obligations entered into force after being published in the Official Gazette.
According to the law, agreements regarding the rental price to be applied in the renewed rental periods between June 11, 2022, when the law came into force, and July 1, 2023, when the law came into force, will be valid provided that it does not exceed 25 percent of the rental price of the previous rental year.
If the rate of change in the consumer price index of the previous rental year is below 25 percent compared to the 12-month averages, the rate of change will be valid. This rule will also be applied to lease agreements for more than one year.
Contracts made to exceed these rates will be deemed invalid in terms of excess amount.
This provision will also be applied in terms of the decisions to be made by the judge, in accordance with the regulation on the determination of the rental price according to the 12-month averages in the consumer price index of the previous rental year, according to the regulation on the determination of the rented property in an equitable manner, if an agreement has not been made by the parties.
IT WILL NOT BE BOUND BY THE LAWYER'S INTERNSHIP
According to the law, working as an insured in any job will not prevent the practice of attorneyship, provided that it does not actually prevent the internship. Except for judicial and administrative judiciary judges and prosecutor candidates and those from the profession of judges and prosecutors, those who work in staff or positions in public institutions and organizations will also be able to do attorneyship internships during their duties. Necessary convenience will be provided by the relevant units for the internship. In provinces where there is more than one bar association, a legal aid office will be established by each bar association. Assignments to be made upon the request of the judicial authorities will be made through the electronic information system created by the Union of Turkish Bar Associations, taking into account equality among the lawyers in that province. The principles of distribution between bar associations are determined for the appropriation transferred to the account of the Union of Turkish Bar Associations by the Ministry of Treasury and Finance to be used for legal aid services.
IT WILL BE ADDED TO THE LAW SOCIETY'S SCORE
Accordingly, the distribution of the money sent from the allowance between the bar associations will be based on scoring. In scoring, 5 basic points will be given to each bar association. The points to be added to this basic score will be determined based on the number of members of the bar associations and the population of the provinces.
One point for every 50 lawyers registered to the bar association and one point for every 5 thousand population based on the population of the province will be added to the bar association's score. In provinces where there is more than one bar association, 40 percent of the total score to be determined for each 5,000 population will be calculated equally among the bar associations in that province, and the remainder will be calculated by dividing the total number of lawyers registered in that province by the number of members of each bar association. will be distributed according to points.
