The summaries of proceedings regarding the lifting of the immunity of 3 deputies, including Green Left Party Muş Deputy Sezai Temelli, were submitted to the Presidency of the Turkish Grand National Assembly.
In addition to Temelli, the incoming summaries also include the files of MHP Istanbul Deputy İsmail Faruk Aksu and MHP Afyonkarahisar Deputy Mehmet Taytak.
Presidential Decrees on the Lifting of Legislative Immunity were referred by the Presidency of the Parliament to the Joint Commission Consisting of Members of the Constitution and Justice Commission.
HOW DOES THE PROCESS WORK?
Presidential Decrees on the Lifting of Legislative Immunity are referred by the Presidency of the Parliament to the Joint Commission Consisting of Members of the Constitution and Justice Commission.
The Joint Commission creates its own agenda for the referred files, and the Preparatory Commission is established to examine the legislative immunity files.
According to the Internal Regulation of the Grand National Assembly of Turkey, the Preparatory Commission submits its report to the Joint Commission within 1 month at the latest.
The Joint Commission discusses the Preparatory Commission report and makes a decision. The Joint Commission decides whether to lift the immunity or postpone the prosecution until the end of his capacity as a member of parliament.
The member of parliament whose immunity is requested can defend himself orally or in writing in the Preparatory Commission, in the Joint Commission and in the General Assembly of the Turkish Grand National Assembly after presenting the report of the Preparatory Commission, or can have any member of parliament defend him.
SUBMITS THE REPORT TO THE JOINT COMMISSION
The Joint Commission reports regarding the removal of immunity go directly to the agenda of the General Assembly.
Following the discussions in the General Assembly, the Joint Commission's report on the removal of legislative immunity is put to vote.
If accepted in the General Assembly, the parliamentarian's immunity is lifted for the file in question.
The Presidency of the Parliament sends the file to the Ministry of Justice through the Presidency.
The Ministry also transfers the file to the relevant prosecutor's office to take necessary action against the MP whose immunity has been lifted.
