Milli Gazete reached the court decisions and the expert report on the luxury residences built within the scope of the urban transformation development plan on the most valuable land of Ankara.
It has been revealed that YDA has built 180 thousand square meters of salable area on 49 thousand 139 square meters of land by taking advantage of the canceled urban transformation development plan.
While the average square meter sales price of apartments in luxury residences is around 50 thousand liras, the monetary value of 180 thousand square meters of salable area is approximately 10 billion liras.
A huge profiteering effort came from under the 6-block luxury residences built by YDA as part of the urban transformation project on Ankara's most valuable land, right across the Presidential Complex, by the farmer's organization Agricultural Credit Cooperatives.
In order for a parcel to be declared an urban transformation area, the condition of 50 thousand square meters must be met.
It came to the agenda that 49 thousand 139 square meters of parcel belonging to Agricultural Credit Cooperatives was not sufficient for the urban transformation area alone, and it was unlawfully combined with a 1774 square meter parcel belonging to a person in a different place that is not adjacent to it and declared an urban transformation area.
It turned out that the unlawful development plan of the Ankara Metropolitan Municipality was canceled by the courts dozens of times.
INTENDED ON UNLAWFUL URBAN TRANSFORMATION PLAN
Although the urban transformation plans taken by the Ankara Metropolitan Municipality Council for the years 2011, 2012, 2013 and 2014 were canceled by the court each time. It was noteworthy that the construction area and the precedent were increased each time in favor of YDA, and continued on the urban transformation plan, regardless of the court's annulment reasons.
The urban transformation plan, which was last approved by the Ankara Metropolitan Municipality Council in 2017, was canceled on March 23, 2022 by the 8th Administrative Case Division of the Ankara Regional Administrative Court, with the lawsuit filed by the Ankara Branch of the Chamber of Architects of TMMOB.
ZONING PLAN OF LUXURIOUS RESIDENCES ACROSS THE PRESIDENTIAL COMPLEX HAS BEEN CANCELED
The fact that luxury residences built on Ankara's most valuable land, right across the Presidential Complex, are in danger of being demolished, has painfully revealed how the urban transformation project has been abused.
It is wondered what kind of decision the Council of State will make with the canceled urban transformation zoning plan.
RESIDENCE LICENSE WAS GIVEN WHILE THE LEGAL PROCESS CONTINUES
At a time when the legal process regarding the urban transformation zoning plan of the luxury residences, consisting of 6 blocks built on the farmer's land, was continuing, the issue of the settlement license with the decision of the Ankara Metropolitan Municipality Council in 2019 drew attention.
Had the luxury residences built by YDA not been granted occupancy permits in 2019, luxury residences would have faced the risk of collapse, just like TOGO towers, after the decision of the Ankara Regional Administrative Court.
YDA APPEALED THE DECISION OF THE ANKARA REGIONAL ADMINISTRATIVE COURT
Answering the National Newspaper's questions on the subject, YDA's statement noted the following:
"Ankara Regional Administrative Court, dated 23.03.2022 and numbered 2022/524 and numbered 2021/760 E. given over the file numbered 2021/771 E. of the 5th Administrative Law Department of Ankara Regional Administrative Court, dated 23.03.2022 and 2022/506 K. against the decisions numbered; An appeal was lodged, stating that 'the Urban Transformation and Development Project Area announced in the aforementioned parcels was prepared within the framework of the law, and a planning strategy in accordance with the law and relevant zoning regulations, principles and principles of urbanism and the public interest' was applied, and the appeal review is still ongoing."
YDA MADE A BIG PROFIT WITH THE CANCELED PLAN
Despite the cancellation of the urban transformation zoning plan, it turns out that YDA earned a large amount of rent due to the precedent increase and privileged zoning rights provided to it with the canceled urban transformation zoning plan.
In the expert report submitted to the Judge of the 17th Civil Court of First Instance in Ankara in 2019, it was revealed with the unjust enrichment figures obtained with the unlawful urban transformation zoning plan.
In the aforementioned expert report, it was noted that although YDA's land belonging to Agricultural Credit Cooperatives is 49,137 square meters, it has built approximately 180 thousand square meters of salable area based on the license, which corresponds to almost 3.7 times its counterpart in terms of land area.
180 THOUSAND SQUARE METERS OF SALE AREA WAS BUILT!
While the equivalent of luxury residences in the project is 2.3 according to the existing land size, it was stated in the expert report that 180 thousand square meters of salable area was built on 49 thousand 137 square meters of land, revealing that the increase in precedent was not followed in the project.
While the average selling price of the normal apartments in the luxury residences opposite the Presidential Complex is around 50 thousand liras on a square meter basis, the monetary value of the 180 thousand square meters of salable area is approximately 10 billion liras.
