The prison sentences given to 22 of the 27 defendants on trial for organizing the stopping of MIT trucks in Adana and Hatay were upheld by the 3rd Penal Chamber of the Supreme Court of Appeals.

After the legal investigation of the file, which was concluded on October 30, 2020 by the Adana 13th High Criminal Court, was completed by the Adana Regional Court of Justice 2nd Penal Chamber, it was sent to the 3rd Penal Chamber of the Supreme Court of Appeals.
 
The 3rd Penal Chamber of the Supreme Court of Appeals, which completed its review of the appeal, announced its decision regarding the file.
 
In the decision, it was stated that the procedural procedures in the trial process were carried out in accordance with the law for the 22 defendants for whom a sentence of conviction was established, that all the evidence taken as a basis for the verdict was obtained in accordance with the law, that the claims and defenses were discussed without changing their essence, and that his conscientious opinion was based on precise, consistent and non-conflicting data.
 
In the decision, which included the determination that the evidence is legally valid and suitable, that the increase and reduction of punishment for the defendants is based on legal justification, “Since the actions are described as correct and comply with the type of crime stipulated in the law, and the reasons put forward by the defendants and their lawyers in the appeal petitions are not found to be appropriate, the conviction provisions are rejected on the merits, It has been decided to uphold the acquittal and the verdicts stating that there is no room for sentencing.”
 
Supreme Court overturned conviction of 5 defendants
 
The 3rd Penal Chamber of the Court of Cassation, former gendarmerie staff colonel defendant Ömer Arık, who was sentenced to aggravated life imprisonment by the local court for “attempting to overthrow the constitutional order”, and the defendants Hasan Bektaş and Mustafa İlhan for “establishing and leading an armed terrorist organization”, 15 each. It overturned the sentence regarding the 18-year prison sentences given to Mehmet Cevher Koyuncu and Süleyman Gürbüz, due to “mistake in criminal nature”.
