In the practice of expert teaching and head teacher, which was brought together with the Teaching Profession Law, reactions to the education and exam practice continue to come. "Egitim-Gücü-Sen" educators union brought the teacher training that started during the summer vacation to the judiciary and demanded that the execution be stopped.
It was decided that the 'Training Program', which came into force with the written exam requirement for specialization titles together with the regulation on candidate teaching and career steps, would be held during the summer vacation period due to the teachers' busy academic year.
While this decision, which was published in the official newspaper, caused reactions, the trainings started with the start of the summer vacation.
The union, on the other hand, stated that the trainings started usurped the legally given 2 months summer vacation right to teachers and took the trainings to the court.
“TRAININGS ARE ORGANIZED ILLEGALLY”
In the statement made by the union regarding the court, drawing attention to the fact that the trainings are contrary to the laws under the title of 'Teachers' leave and holidays' within the scope of the Basic Law of National Education.
"Teachers' vacation periods are stated in the law, 'Teachers are on leave for two consecutive months during the summer vacation. However, they are obliged to participate in the work related to the profession to be determined by the regulation during the holidays that remain untouched by these two-month leave periods. Accordingly, the determination regarding the realization of the training program in the subject regulation during the summer vacation; It is clearly contrary to the aforementioned provision of the law, as it is intended for a period that cannot be touched in any way, including in-service training, where teachers are on leave of two months uninterruptedly," the statement said.
"THE DAMAGES THAT MAY BE CAUSED CANNOT BE CORRECTED BY POST-REGULATION"
In the statement, it was emphasized that participation in the trainings is mandatory for teachers who want to achieve their rights as specialist teachers and head teachers.
"Teachers are forced to make a choice between the education they have to attend in order to advance on the career ladder and the right to rest, which is guaranteed by the Constitution and the law. This issue has nothing to do with promotion in the career ladder, development of material and spiritual existence, the right to education and the right to rest, as regulated in the Constitution, and it will not be possible to eliminate the damage to be caused by the application in terms of the people who are the addressee of the application with a decision of annulment in the future. For this reason, we have decided to sue for the stay of execution," the statement added.
