The 19th Penal Chamber of the Supreme Court of Appeals, which canceled the traffic fine for the driver who crossed the speed limit and passed the red light in order to bring his sick father to the hospital, signed a precedent decision.
 
According to the decision of the Supreme Court of Appeals, a citizen living in Samsun exceeded the speed limit and passed the red light to bring his sick father to the hospital.
 
The driver told the traffic cops who stopped the vehicle that he was trying to get his father to the hospital, but he was asked for a driver's license.
 
The driver, who continued to drive the vehicle, brought his father to the hospital.
 
A few days later, the driver, who learned that a fine was written on the license plate, appealed to the magistrate, but his appeal was rejected.
 

SUPREME COURT CANCELED TRAFFIC FINE

 
Stating that the driver violated the rules in order to bring his patient to the hospital, he demanded that the penalty be reversed due to the superiority of the pass.
 
The 19th Penal Chamber of the Supreme Court of Appeals, which canceled the penalty imposed on the driver, stated in its decision that the situation was a state of necessity.
 
In addition, it has been understood in the decision that it cannot be held responsible for traffic restrictions and prohibitions due to the presence of 'transit superiority', which is one of the 'reasons for compliance with the law', provided that the audible and visible signal of crossing is given.
