At the beginning of the year, with the publication of the law on the recruitment of contracted public servants in the Official Gazette, attention was drawn to the grievances.
While the Ministry of National Education has published the announcement of excused relocation of teachers, it has been stated that teachers who have been transferred from contracted teaching to staff with the Law No. 7433 will not be able to benefit from this right.
While Educators Union "Türk-Egitim-Sen" filed a lawsuit against this situation, Anadolu Education Syndicate (AES) made a request by sending an official letter to the Ministry of National Education (MEB).
While teaching on a contractual basis, teachers who were appointed to the staff with the arrangement made at the beginning of the year are now experiencing a new grievance by being excluded from the right to excused appointment.
With the right to appoint with excused, teachers had the right to relocate within and between provinces depending on excuses for family unity, health, life safety, disability, and other reasons, while teachers who were appointed to new positions were deprived of this right. Against this situation of teachers, two unions took action.
In its statement, the union stated that the teachers who were appointed to the staff were deprived of the right to change their place with an excuse, and it was pointed out that the condition of working for a total of 3 years, with contract and permanent staff, is contrary to the principle of legal security and equality of the Constitution.
In the statement, reminding that the protection of family unity is protected by the Constitution, "As Türk Eğitim-Sen, we have filed a lawsuit in the 2nd Chamber of the Council of State for the suspension of execution and then the cancellation of the regulations of the 2023 Summer Vacation Teachers' Relocation Due to Excused Announcement, which requires a total working period of three years for contracted and permanent staff," it was stated.
