Temporary relocation of academic staff canceled by the Council of State

With the amendment made to the Inter-Institutional Temporary Assignment Regulation, "Eğitim-Bir-Sen" had brought to the Council of State the regulation regarding the removal of universities from the scope of the regulation and the deprivation of the right of academic and administrative staff to make temporary relocations between universities.

In the case heard, it was decided to cancel the regulation. If the regulation was implemented, academic staff would once again be victimized.
 
With the amendment published in the Official Gazette on 29.02.2020 regarding optional relocations of academic staff, their existing rights would be taken away.
 
This regulation was brought to the Council of State by Educators Union (Eğitim-Bir-Sen).
 
The Council of State announced its decision regarding the case.
 
The regulation that would cause the academic staff to suffer has been cancelled.
 

TAKING THE RIGHTS OF ACADEMIC STAFF WAS MADE THE SUBJECT OF A LAWSUIT

 
In the written statement made by "Eğitim-Bir-Sen", with the amendment made to the Inter-Institutional Temporary Assignment Regulation in the Official Gazette dated 29.02.2020, universities were excluded from the scope of the regulation.
 
It was pointed out that the deprivation of the right of academic and administrative staff to make temporary inter-university relocations was filed with the Council of State.
 
In the case filed, it was announced that the Council of State decided to annul the regulation regarding the exclusion of universities from the scope of the Inter-Institutional Temporary Assignment Regulation.
 
"With the amendment made in the Inter-Institutional Temporary Assignment Regulation, it was stipulated that 'higher education institutions' cannot make temporary assignments within the scope of this regulation, and temporary assignments made by 'higher education institutions' in accordance with this regulation will be terminated within one month. In this case, temporary assignments of faculty members between universities, whether voluntary or ex officio, for reasons such as academic career, scientific research, joint work, etc., would be prevented, and thus assignments that could meet requests for change of place due to their scientific and academic studies and excuses would be eliminated," it was stated.
 
It was pointed out that if this regulation is implemented, the existing grievance will increase even more.
