More than half of the Palestinians are young people. For this reason, Israel wants to make the youth passive in the society and completely destroy the Palestinians' hope for freedom for the future, by putting the young population of Palestine to the forefront, by implementing policies such as psychological, spiritual, mental, physical, unlawful arrests, detentions and heavy fines against the youth.
ISRAEL'S VIOLENCE CONTRACTS WITH THE CONVENTION ON THE RIGHTS OF THE CHILD
With this psychology, both the educational life, social life and family life of children become dramatic. However, this action of Israel is clearly against the Convention on the Rights of the Child. Pursuant to article 19 of the Convention, states parties to the Convention states that “… bodily or mental assault, violence or abuse, neglect or negligent treatment, including rape, while in the presence of the child's parents or only one of them, their legal guardian or guardians, or any person in their care. for protection against all kinds of abuse and ill-treatment; legal, administrative, social, educational…” While Israel should protect children against violence, it is a clear violation of international law to use violence against children as a state policy.
Another issue that Israel violates the law against children is the unlawful arrests and detentions that limit the right to life. Israel regularly detains children and arrests the majority of them in order to deter and frighten the Palestinian people who resist its occupation. The number of children arrested due to the so-called intensified security measures against Palestinian children is increasing day by day.
According to official Palestinian statistics, over 1,000 children were arrested in the past year alone, a figure well above the number of children arrested in previous years. According to the report, the age range of most of the arrested children ranges from 12 to 15.
As a result of the reports, arrested children make up about 20% of Palestinian youth. Of course, these arrests are not limited to a few days as the Israeli media advertised. Some children even face life imprisonment. During detention, children are subjected to physical violence and sometimes injury. Children who are arrested and taken to military camps are sometimes deprived of going out and are not allowed to see their lawyers or even their families who want to defend themselves during this process. As a result, even at the end of his sentence and his release, the child cannot attain freedom without paying the fine determined by the Israeli regime. In any case, the treatment of children is not in line with human rights.
As a matter of fact, again, 37/2 of the Convention on the Rights of the Child. According to the article, states parties “No child shall be deprived of his liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be required by law and shall only be considered as a measure of last resort and shall be limited to the shortest possible time”.
As can be understood from the provision, the arrest and detention of Israel is clearly against international law, especially in terms of the time spent in this process.
ISRAEL LIMITS CHILDREN'S EDUCATION OPPORTUNITIES
Another fundamental right that Israel violates against Palestinian children is the right to education. The Israeli regime pursues a policy of partially or completely closing educational institutions in order to allow Palestinian youth to participate in the resistance, under the pretext that the crowds of students in schools are used in this resistance, and to deprive children of education. Therefore, while the school for children should be a safe and sheltered structure, for children living in the Palestinian territories under the disproportionate attacks of Israel, the school has become a place where they are exposed to various types of violence. The practices of the occupation state restrict the educational opportunities of children.
According to a 2013 World Bank survey, 60% of young Palestinians (10-24 years old) put education first in their lives. Compared to the countries in the region, Palestine has a very high rate of literacy compared to other countries in the region, with a literacy rate of up to 90%. However, they are also deprived of education at the same rate.
Children who are deprived of education encounter Israeli forces on the streets and this has become their daily behavior and this has become their training ground. Children who are deprived of positive sciences suffer psychologically in this process because they cannot receive a proper education despite their age.
Children's right to education Article 28 of the Convention on the Rights of the Child et al. clearly arranged.
According to the first paragraph of the article, the states parties are obliged to take all kinds of measures to “…recognize the right of the child to education and the gradual realization of this right on the basis of equal opportunity…”.
It is unacceptable for Israel to violate this obligation. Unfortunately, Israel has been recklessly continuing these practices, which disregard international law, for seventy years.
