The “Regulation on the execution of judgments and injunctions regarding the delivery of children and establishing personal relations with the child” prepared by the Ministry of Justice was published in the Official Gazette. According to the new regulation, divorced spouses will not apply to enforcement offices, but to "legal support and victim services directorates" where experts work to see their children. With the entry into force of this regulation, child enforcement practices will also be terminated.
THEY WILL NOT GO TO THE EXECUTIVE OFFICES TO SEE THEIR CHILDREN
With the regulation prepared by the Ministry of Justice and published in the Official Gazette, the duties, authorities and responsibilities, as well as the procedures and principles regarding the execution of the decision and injunction regarding the delivery of a child and establishing a personal relationship with the child, were regulated. Accordingly, the regulation, which aims to prevent secondary traumatization of children during and after the divorce process, ended the practice of child delivery by enforcement. In order to see their children with the new child delivery method, parents will no longer apply to enforcement offices, but to the "Legal Support and Victim Services Directorates" where experts work.
THE EXPENSES WILL BE AFFORDED BY THE MINISTRY
Parents who want to meet with their children will no longer pay any fees. All costs will be covered by the Ministry of Justice. Delivery will not be at the parents' door, but at the child-friendly meeting centers designed to be child-friendly. In all cases, the best interests of the child will be considered first. Specialists and guidance counselors will be in charge of communication and interviewing with the child in the child delivery and personal relationship establishment processes. First of all, the parties will be contacted and they will be guided about the negative effects of conflicts between them on their children and how the process should be carried out. In order to prevent possible new conflicts and tensions, the parties will not be brought face to face unless the parties want it and the best interests of the child require it.
