It has been announced that the Information Technologies and Communications Authority (BTK) has imposed an administrative fine of approximately 51 million 5 thousand liras to 15 companies that were determined to make unauthorized calls for the sale and marketing of internet access services.
The administrative process of BTK regarding unauthorized calls to the sales and marketing of internet access services has been completed.
BTK published its decision on its website yesterday.
Accordingly, in the decision taken on December 27, 2022, it was stated that "Violations of Legislation Related to Agency and Information Disclosure by Some Operators" were examined.
ILLEGAL PRACTICES OF 15 BUSINESSES HAVE BEEN DETECTED
After examining the appreciation and attachments prepared by the Authorization Department, the sub-dealership and agency arrangements of the operators and those who make sales and marketing calls, also known as "unwanted calls", were also examined. 15 operators who were found to have practices contrary to the legislation were identified.
APPROXIMATELY 51,5 MILLION TL ADMINISTRATIVE FINE IMPLEMENTED
With the decision taken by the Information Technologies and Communication Board, the companies that communicated with the citizens through unauthorized calls were imposed an administrative fine of approximately 51 million 5 thousand liras in different amounts.

HOW ARE PENALTIES DETERMINED?
Penalties are applied within the framework of the “Violations of Authorization” of the Information Technologies and Communications Authority Administrative Sanctions Regulation and the “rights and obligations of the operators” of the Authorization Regulation for the Electronic Communications Sector.
According to this; The "Violations of Authorization" of the Information Technologies and Communications Authority Administrative Sanctions Regulation, and an administrative fine of 2 per 100 thousand of the net sales of the previous calendar year.
If the same violation is committed more than once, administrative fines are imposed separately for each violation. This time, the amount of administrative fine to be applied increases to eight per thousand.
An administrative fine of up to three percent of the net sales of the operator in the previous calendar year is applied in violation of the "rights and obligations of the operators" of the Authorization Regulation on the Electronic Communications Sector.
If the same violation is committed more than once, administrative fines are imposed separately for each violation. This rate is calculated as 4% of the net sales amount within the framework of the criteria in the 44th article of the regulation, titled "Sanction criteria".
