A second-hand smartphone was sold as brand new to İbrahim Boyacı, who bought a smartphone from BİM, one of Turkey's largest chain market brands, in February 2019. İbrahim Boyacı, who learned that the warranty of the product he bought was over when his phone failed one after the other, applied to the Consumer Arbitration Committee. After the Consumer Arbitration Committee found İbrahim Boyacı to be right, BİM objected to the decision and took the matter to the judiciary. İbrahim Boyacı is right again in the case where an expert is appointed. When it was found, it was confirmed once again that BİM sold the second-hand phone as a brand new product. İbrahim Boyacı, who was waiting for the chain market to cover its losses after the court decision, made special statements to the Milli Gazete.

İbrahim Boyacı, who has been victimized by BİM and has been seeking his rights before the judiciary for years, said, "The phone we bought from BİM about 2 years ago, as it was brand new, turned out to be second hand. Shortly after we received the phone, the phone started to malfunction. Since it is a new product, we immediately took the phone to the warranty service. The warranty service gave us the phone back by saying that the fault on the phone was fixed, but after a while the phone malfunctioned again. When I took the phone to the warranty service again, they said that the warranty of the product was over. From the warranty service we were told that the phone was sold to someone else 1 year ago. The second-hand phone was sold to us as brand new.”
“EXPERT ALSO FOUND US RIGHT”
İbrahim Boyacı, who applied to BİM for the correction of the mistake made, but did not receive any response, "When the phone we bought as brand new turned out to be second hand, we applied to the regional directorate of BİM, but they did not help. I took the matter to the Consumer Arbitration Committee. The Consumer Arbitration Committee made a decision that the phone is second hand and that BİM should cover my loss. However, BİM took the matter to a higher Consumer Arbitration Committee and this time a lawsuit was filed. An expert was appointed to our case and the expert found us right. I was once again right in the case that was concluded recently. According to the court decision, I should be compensated by BİM, but we have not seen anything yet. However, I will bring the matter to the court again as 'fraud'," he added.
