Exactly six years ago, Mavi Marmara ship which had been on its way to take humanitarian aid to Gaza, was attacked by Israel in the International Waters and were killed 10 citizens, the Mavi Marmara Case against Israel wanted to be buried in the waters. In the past week's session, the prosecutor had been postponed the case to 9 December after the resistance of the martyrs' families. The prosecutor wanted to drop the case by come up with the agreement signed between Turkey and Israel. We asked the lawyers for the prosecutor's request to drop the case. Lawyers said the decision was contrary to the Constitution, and underlined that the judge could not make such a decision.
THE CRIMINAL CASE CAN NOT BE DROPPED WITHOUT AMNESTY LAW
Lawyer Turgut Kazan from the former President of the Istanbul Bar Association: "The law that accepts the Israeli agreement is against the Constitution. Unless the amnesty law that accepted with three out of five., the criminal procedure can not be dropped and the freedom of right of access can not be prevented under an approval law. It must be examined by the Constitutional Court through cancellation or appeal. You can not get people's right to get rights." he said.
TO DROP THE CASE IS AGAINST THE CONSTITUTION
Uğur Yıldırım, the lawyer of Mavi Marmara: "We received opinions from lawyers and constitutional professors in various parts of the world and communicated all of them to the court ...Many provisions of the Constitution are violated ... Fair trial and equality of the Constitution are violated. Unless the amnesty law that accepted with three out of five., the criminal procedure can not be dropped." he said.
FAMILIES SHOULD ACCEPT
Former Justice Minister Hikmet Sami Türk said: "The agreement of the two countries is not enough. The material and moral damages of people who have lost their relatives need to be compensated. It is important to how it is going to be calculated. Families who are tainted must also be satisfied. If these families are not satisfied, then the problem is not solved." he said.
Lawyer Cuneyt Toraman: "After the prosecutor demanded that the case to be dropped, we told the court delegate that the public case could not be reduced with any agreement." he said.
