The 9th Civil Chamber of the Supreme Court of Appeals has made a very important decision in our country, where the economic crisis prevails and the cries of millions of people working for minimum wages are rising.

The 9th Civil Chamber of the Supreme Court of Appeals, which signed a decision that closely concerns millions of private sector employees, ruled that a skilled worker's living with minimum wage in metropolitan cities is contrary to the ordinary flow of life. 
 
Working as a lawyer's clerk in a law firm, the young man resigned, stating that his wages were not paid. The clerk, who went to the Labor Court, noted that he worked as a secretary in the law office for the last time with a net salary of 4,000 TL. 
 
The plaintiff clerk, who stated that he terminated his employment contract with just cause because his wages were not paid for months, stated that he could not take annual leave because he was the only employee in the workplace, that he kept his own expense agendas to prove the real wage, that he would pay his receivables if the employer gave him a resignation letter, that he did not submit a resignation letter, that his rights were not paid. He claimed that severance pay, annual leave and wage receivables, together with interest, be decided to be collected from the defendant. The defendant's lawyer, on the other hand, denied the allegations, stating that the clerk was working for minimum wage. The court ruled that the case be partially accepted. When both parties appealed against the decision, the 9th Civil Chamber of the Supreme Court intervened.
 

WORKING FOR MINIMUM WAGE IS NOT SUITABLE FOR THE ORDINARY FLOW OF LIFE

 
In the decision of the Supreme Court; It was emphasized that the job being a qualified job was not suitable for the ordinary course of life to work with minimum wage, considering the city where the worker lived. It was reminded that from time to time, wages shown in employment contracts or payrolls do not reflect the truth in order to pay less taxes or insurance premiums in working life. In this case, it was stated that the determination of the real wage gained importance, and that the issues such as the seniority of the worker, the job title, the actual job, the characteristics of the workplace and the wages paid to the peer workers were taken into consideration.
